Contingencies can protect you from some of these risks.<\/p>\n<p><b>Here\u2019s an overview of what contingencies are and which ones you might include in your offer:<\/b><\/p>\n<ul>\n<li><a href=\"#what-is-contingent-offer\">What is a contingent offer?<\/a><\/li>\n<li><a href=\"#how-often-contingent-offers-fall-through\">How often do contingent offers fall through?<\/a><\/li>\n<li><a href=\"#types-contingencies\">Types of contingencies<\/a><\/li>\n<li><a href=\"#should-make-contingent-offer\">Should you make a contingent offer?<\/a><\/li>\n<\/ul>\n<p><a name=\"what-is-contingent-offer\"><\/a><\/p>\n<h2>What is a contingent offer?<\/h2>\n<p>A contingent offer is an <a href=\"https:\/\/www.credible.com\/blog\/mortgages\/making-an-offer-on-house\/\">offer to purchase a home<\/a> that includes clauses allowing you to walk away from the deal if certain conditions aren\u2019t met. You\u2019ll typically get your <a href=\"https:\/\/www.credible.com\/blog\/mortgages\/earnest-money\/\">earnest money<\/a> back, too, as long as it\u2019s written in the contract.<\/p>\n<p>Buyers often include <a href=\"https:\/\/www.credible.com\/blog\/mortgages\/loan-contingencies\/\">loan contingencies<\/a> to protect themselves in the homebuying process. You have several contingencies to choose from, but the most common contingency clauses are:<\/p>\n<ul>\n<li>Appraisal contingency<\/li>\n<li>Home inspection contingency<\/li>\n<li>Financing contingency<\/li>\n<\/ul>\n<p>Sellers can either accept your offer, decline it, or negotiate the contingency details before moving forward.<br \/>\n<a name=\"how-often-contingent-offers-fall-through\"><\/a><\/p>\n<h2>How often do contingent offers fall through?<\/h2>\n<p>Contingencies rarely cause an offer to fall through, but it does happen. In May 2020, 76% of recently closed home sales included purchase contingencies, and 9% of all contracts were ultimately terminated, according to the <a href=\"https:\/\/www.nar.realtor\/sites\/default\/files\/documents\/2020-05-realtors-confidence-index-06-22-2020.pdf\">National Association of Realtors<\/a>.<\/p>\n<p>Among those canceled contracts, 7% were terminated due to problems with contingencies.<br \/>\n<a name=\"types-contingencies\"><\/a><\/p>\n<h2>Types of contingencies<\/h2>\n<p>Once you choose a home you\u2019d like to buy, you or the real estate agent will send a purchase offer to the seller. You can decide whether to include contingencies, and the seller can decide whether to accept the offer and may negotiate the details.<\/p>\n<p>If you\u2019re not sure which contingencies to include, your real estate agent can provide guidance.<\/p>\n<p>Here are some of the more common contingencies:<\/p>\n<h3>Home inspection contingency<\/h3>\n<p>In the NAR report, 59% of homebuyers included a home inspection contingency in their offer \u2014 by far the most common type. The <a href=\"https:\/\/www.credible.com\/blog\/mortgages\/home-inspection\/\">home inspection<\/a> clause gives you the right to have the home professionally inspected, which protects you against purchasing a home with significant and expensive issues.<\/p>\n<p>Sellers typically want the inspection to take place within days of accepting the offer, so you (the buyer) can decide quickly whether you\u2019ll go through with the home purchase.<\/p>\n<p>If the home inspector finds issues, you can negotiate the sales price, ask for repairs, or cancel the offer and potentially get your earnest money back.<\/p>\n<h3>Appraisal contingency<\/h3>\n<p>During the underwriting process, the lender will order an <a href=\"https:\/\/www.credible.com\/blog\/mortgages\/home-appraisal\/\">appraisal<\/a> to figure out how much the home is worth. If the home appraises for less than the purchase price, you\u2019ll need to cover the difference or negotiate with the seller to lower the price.<\/p>\n<p>But if you can\u2019t reach an agreement, the appraisal contingency allows you to cancel the deal and avoid overpaying for the home.<\/p>\n<h3>Financing contingency<\/h3>\n<p>Although homebuyers typically <a href=\"https:\/\/www.credible.com\/blog\/mortgages\/preapproval\/\">get pre-approved for a mortgage<\/a> before starting the homebuying process, it\u2019s not a guarantee they\u2019ll pass the underwriting review. If you don\u2019t sell the home within that time frame, you either cancel the contract or move forward.<\/p>\n<p>There are two types of home sale contingencies:<\/p>\n<ol>\n<li><b>Sale and settlement contingency:<\/b> Under this contingency, you\u2019re trying to sell your home but haven\u2019t received an offer yet.<\/li>\n<li><b>Settlement contingency: <\/b>This contingency is when you have an offer or a signed purchase and sales agreement, and you\u2019re waiting for the closing to take place.<\/li>\n<\/ol>\n<p>Sellers are more likely to accept a settlement contingency since you\u2019re farther along in the selling process.<\/p>\n<h3>Coronavirus contingency<\/h3>\n<p>A coronavirus contingency allows a homebuyer to back out of the transaction or make slight changes to the contract if the pandemic interferes with their home purchase.<\/p>\n<p>For example, the contingency might allow you to cancel the contract if you lose your job because of the pandemic. They may even hurt your chances of getting the home of your dreams in a seller\u2019s market.<\/p>\n<p>In May 2021, 28% of homebuyers waived the appraisal contingency and 25% waived the inspection contingency, according to another NAR report.<\/p>\n<div class=\"basic-box\" style=\"border: 1px solid #E2E4E6;\"><div class=\"basic-box__inside\"><b>Tip: <\/b>The main benefit of using a contingency is protection against risks like defects in the home or mortgage approval falling through. The drawback is that sellers may turn down your offer if they don\u2019t want to accept contingencies.<\/div><\/div>\n<p>Only you know what you\u2019re comfortable waiving, though.
